What is Sexual Harassment?
Sexual harassment is unwelcomeconduct of a sexual nature in relation to a person which could reasonably be expected to cause:
Humiliation
Offence, or
Intimidation.
Unlike discrimination, sexual harassment doesn't have to occur in a specific area to be unlawful. It can occurANYWHERE and it only has to occur ONCE, not repeatedly, to be unlawful.

Watch Your Body Language
1. Look away
Always avert your eyes. If you have a passenger with a short skirt getting in or out of your car, look in the opposite direction. If you have a passenger changing clothes in the vehicle don’t look. Respect your passengers’ privacy while also driving safely.
2. Keep your eyes on the road
Don't keep looking at the passenger during a journey, even if you are engaged in a conversation with them. It may make your passenger feel uncomfortable or be perceived as rude and most importantly it is an unsafe driving practice. Keep your eyes on the road and focus on safely delivering your passenger to their destination.
Ensure your eyes are only directed to where they are needed to ensure you are providing a safe journey for your passenger. If you are watching your passenger or attempting to listen in to their conversation then you are distracted from driving. Distracted driving is dangerous.
3. Don't touch your passengers without their permission
There is not often a need to touch your passenger but when there is – for example, you need to help with a seatbelt – you must ask their permission first.

1.Act professionally
Your passenger may be having a personal or intimate conversation on the phone or with another passenger. A professional driver does not acknowledge the conversation and especially does not attempt to join in, pass comment or ask questions.
2.Remember that your passengers are taking a ride, not looking for a date
When your passengers book a ride with Ola, they are not looking to hook up with the driver. Unwelcome sexual humour, innuendoes and requests for a date will more than likely be unwelcomed and will make your passenger feel uncomfortable or may even be sexual harassment.
If you do cross the line and ask a passenger out on a date and if they say no, don’t ask again. NO means NO.
3. If they're drunk, do not assume this is "your chance"
As a driver, you have a responsibility to ensure the safety of your passenger. An intoxicated passenger is vulnerable and cannot consent to anything.
4. No dirty jokes or stories
Don’t share sexually-oriented jokes or stories with your passengers.
EXAMPLE: Just because a friendly young person is chatting with you, doesn’t mean he wants to hear your dirty joke.
5. Don't take photos of your passengers
It’s just plain creepy and inappropriate for a driver to take photos of passengers. Please respect the privacy of your passengers and never take photos.

Validating Your Behaviour
If you have to ask someone if your behaviour is OK, it's probably not.
If you have any doubts as to your behaviour ask yourself:
if you would like someone to do the same to someone you care about.
if you would like to see a picture of yourself and a description of the behaviour on the front page of the newspaper.
If you answer "NO" to either of these questions, you should refrain from the behaviour!
Remember that when assessing for harassing behaviours, it is not the intent of the 'harasser' that matters but rather the impact the behaviour has on the person who is offended/harassed by the behaviour.

The Consequences
The Consequences of Discrimination
Discrimination, Vilification and Sexual Harassment not only affect the victim but they may have serious consequences for the perpetrator.
The consequences may be:

Tarnished reputation
A driver who discriminates or sexually harasses passengers, will end up losing the respect of peers and family. Once they are found out they will no doubt lose the respect of people they care about and of everyone who knows how they have behaved.

Limited work opportunities
If a driver is reported and the report is substantiated, the driver will more than likely be off-roaded and possibly disassociated with Ola. They will more than likely find it difficult to find other work as word of this behaviour spreads easily. Booking Entities only want to work with drivers who treat passengers respectfully.
In Queensland, Ola has an obligation to notify the Department of Transport & Main Roads of any drivers disaffiliated for serious misconduct. DTMR may decide to disqualify the driver from holding a DA, which means they will not be able to work as a driver in Queensland or possibly other states in Australia.

Prosecution and incarceration
Discrimination and Sexual Harassment are unlawful. If a driver has broken the law there is a chance they will be charged. Some cases may have implications under criminal law, for example, sexual assault, indecent exposure, stalking or obscene communications.

Loss of income
If a driver is off-roaded or disassociated from Ola because their conduct was found to be unlawful, they may experience financial stress.

Damage to the business reputation
If a passenger has a bad experience, they don't keep it to themselves. Even if they don't formally report the behaviour, they will probably tell others and tarnish the name of the Booking Entity. This means less work for the business and less work for all drivers in that business.
